Terms of sale
TERMS OF SALE
1. INTRODUCTION
1.A - Scope
These Terms of Sale apply to all orders placed on our online store Brunelia.fr. This store is intended exclusively for individual consumers and is not aimed at professionals or businesses wishing to make bulk purchases.
A “consumer” is defined as “any natural person who acts for purposes that fall outside their commercial, industrial, craft, professional or agricultural activity.”
The contract is concluded between you (the consumer) and EURL AFFISEO (“Brunelia.fr”), registered at Bureau 3, 8 rue de la République, 13001 Marseille, France. Our contact details are available on our website.
1.B - Purchase conditions
You must be at least 18 years old to place an order. In accordance with French law, we do not accept any purchase on credit from minors. We reserve the right to refuse or modify an order if the customer has provided inaccurate information.
1.C - Product availability
Brunelia.fr cannot be held liable for stock shortages, errors in a product description or price changes (e.g. supplier fluctuations, typos). If there is a price error on a product you have ordered, we will inform you promptly and wait for your confirmation before shipping the order.
1.D - Intellectual property
The Brunelia.fr website and its content (trademarks, product names, visuals, graphics) are protected by intellectual property law and may not be used without our written permission.
1.E - Language of the contract
The official language of the contract is French.
1.F - Creation of visuals and presentation photos
Brunelia poster visuals are created in part with the help of artificial intelligence tools. Each visual is then selected, prepared and retouched by the Brunelia team before being offered for sale.
Lifestyle photos (poster on a wall, in a room, leaning or framed) are shown for illustrative purposes: they are digitally generated or composed. The frame and decorative objects that appear in them are not included, unless otherwise stated on the product page.
Colors may vary slightly between what you see on screen, which depends on each device’s settings, and the printed paper.
2. CUSTOMER INFORMATION
2.A - Accuracy of information
When you place an order, you must provide accurate and complete information. Any error in the data provided (address, email, phone number) may cause delays or the cancellation of your order. How we process personal data is detailed in our Privacy Policy.
3. PRODUCT CONTRACTS AND ORDERS
3.A - Ordering conditions
To order on our site, you must accept the Terms of Sale. By placing your order, you also acknowledge that you have read our Privacy Policy.
3.B - Order confirmation
A purchase contract is concluded when Brunelia.fr confirms your order by email. We recommend that you keep this email. You may cancel your order as long as it has not been confirmed. In that case, any payment will be refunded immediately.
3.C - Sales to individuals
We sell exclusively to individuals (B2C). An invoice will be provided with your purchase, including the applicable taxes and your customer information.
4. PRODUCT PRICES AND PAYMENT
4.A - Prices
Prices displayed on Brunelia.fr are shown in the currency of your delivery country. For EU countries, prices include VAT. For other countries, prices exclude local taxes, duties and import fees, which are not collected at checkout and are paid by the recipient. Shipping costs are not included and are shown at checkout.
4.B - Payment methods
You may pay using the payment methods available on the site. We reserve the right to change or restrict the accepted payment methods.
5. SHIPPING AND DELIVERY
5.A - Delivery times
Products are delivered within 3 to 5 business days in mainland France and within 3 to 30 business days elsewhere, depending on the country, as set out in our shipping policy. Unless otherwise agreed, delivery will take place no later than 30 working days after order confirmation.
5.B - Delivery area
We deliver to France, the rest of Europe (except the United Kingdom) and most countries worldwide. The countries available are those offered at checkout.
5.C - Delivery options
We offer a single delivery method. Shipping costs and the free shipping threshold depend on the delivery country (for example €4.95, free from €59, in mainland France) and are listed in our shipping policy.
5.D - Lost parcels
If a parcel is lost, Brunelia.fr takes charge of tracking and resolving the issue.
6. RIGHT OF WITHDRAWAL
Notifying Brunelia of your withdrawal
You have 14 days from receipt of your order to notify us of your decision to withdraw, without having to give a reason. For an order delivered in several shipments, the period runs from receipt of the last item. The legal rules for calculating and extending the period remain applicable.
You may send us a clear statement at contact@brunelia.fr or by post to EURL AFFISEO (Brunelia), Bureau 3, 8 rue de la République, 13001 Marseille, France. Please include the details needed to identify your order. The template below is optional: any other statement clearly expressing your decision is also valid.
Returning the posters
You then have 14 days after sending your statement to return the goods to us. Please contact us to get the return address suited to your order: the manufacturer’s address or the one shown on a parcel is not necessarily the return address. Getting in touch with us is not a condition of the validity of your withdrawal.
Protect the posters for transport; you may reuse the original packaging or suitable packaging. The absence of the original packaging does not, on its own, lead to a refusal. Any reduction in value may only relate to handling beyond what is necessary to examine the nature, characteristics and proper functioning of the item, under the conditions set by law. Keep proof of shipment.
The direct costs of returning an item following a change of mind are your responsibility. This rule does not apply to the handling of a defective or non-conforming product under the statutory guarantees.
Refund
We will refund you without undue delay, and no later than 14 days after being informed of your withdrawal. For a sale of goods, we may defer the refund until we have received the goods back or until you provide proof of shipment, whichever comes first.
If you withdraw from the entire order, the refund includes the initial standard delivery costs. The extra cost of a more expensive delivery method expressly chosen by you is not refunded. The refund is made using the original payment method, unless you expressly agree to another method at no cost to you.
Standard posters and exceptions
A catalog poster printed after the order, in a standard size offered on the site, keeps the right of withdrawal. Print on demand does not, on its own, constitute personalization. Any legal exceptions, in particular for a clearly personalized item, must apply to the product concerned and be brought to your attention before purchase; no general exclusion applies to standard posters.
Withdrawal form template
To EURL AFFISEO (Brunelia), Bureau 3, 8 rue de la République, 13001 Marseille, France, contact@brunelia.fr:
I hereby give notice that I am withdrawing from my contract for the following goods: [goods concerned].
Ordered on: [date] / received on: [date].
Order number, if available: [number].
Full name: [name].
Address: [address].
Date: [date].
Signature only if sent on paper.
7. STATUTORY GUARANTEES
Statutory guarantees are exercised with EURL AFFISEO, Bureau 3, 8 rue de la République, 13001 Marseille, France. To contact us: contact@brunelia.fr. Please provide your order number and the problem you have noticed to help us process your request.
These guarantees are separate from the right of withdrawal for a change of mind.
The consumer has a period of 2 years from delivery of the goods to enforce the statutory guarantee of conformity if a lack of conformity appears. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.
Where the sales contract for the goods provides for the continuous supply of digital content or a digital service for a period of more than 2 years, the statutory guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.
The statutory guarantee of conformity requires the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.
The statutory guarantee of conformity entitles the consumer to have the goods repaired or replaced within 30 days of their request, free of charge and without major inconvenience to them.
If the goods are repaired under the statutory guarantee of conformity, the consumer benefits from a 6-month extension of the original guarantee.
If the consumer requests repair of the goods but the seller imposes replacement, the statutory guarantee of conformity is renewed for a period of 2 years from the date the goods are replaced.
The consumer may obtain a reduction of the purchase price while keeping the goods, or end the contract and be fully refunded upon return of the goods, if:
1° The professional refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a period of 30 days;
3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer ultimately bears the cost of collecting or removing the non-conforming goods, or bears the installation costs of the repaired or replacement goods;
4° The lack of conformity persists despite the seller’s unsuccessful attempt to bring the goods into conformity.
The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is then not required to request repair or replacement of the goods beforehand.
The consumer is not entitled to termination of the sale if the lack of conformity is minor.
Any period during which the goods are immobilized for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.
The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code (code de la consommation).
A seller who in bad faith obstructs the enforcement of the statutory guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).
The consumer also benefits from the statutory guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code (code civil), for a period of 2 years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund upon return of the goods.
8. CUSTOMER SERVICE AND COMPLAINTS
8.A - Contact
For any question or complaint, you can contact our customer service by email at contact@brunelia.fr.
8.B - Dispute resolution
In the event of a dispute, and provided the legal conditions are met, we will take part in a consumer mediation procedure. The European Consumer Centre France is available to provide you with information and to direct you to the competent out-of-court dispute resolution body.
9. CHANGES TO THE TERMS OF SALE
We reserve the right to change these Terms of Sale at any time. The new terms will apply to orders placed after they are updated.
10. FORCE MAJEURE
We cannot be held liable for delays or service interruptions caused by unforeseen events (strikes, natural disasters, health crises, armed conflicts, etc.).
If the situation lasts more than 2 months, Brunelia.fr and its customers may cancel the order without compensation.
11. SEVERABILITY
If any provision of these Terms of Sale is found to be invalid, the remaining provisions stay in force.
12. GOVERNING LAW AND DISPUTE RESOLUTION
In the event of a dispute, we favor an amicable settlement. These terms are governed by French law, without depriving the consumer of the mandatory protections that apply to them.
